Terms of Use

The Performance-based Academic Coaching Team (PACT) system provides a format for teachers to search for resources, question, discuss, reflect, and learn from new and experienced colleagues. Facilitated assistance is available throughout the week excluding Texas A&M System holidays. In order to aid in the assurance of respect within the PACT community, and the User being able to productively utilize the PACT system, users must agree to abide by each of the following policies before participation can be granted in the PACT community:

Acceptance of Terms

Before registering to use the services offered on the PACT site contained therein, you (the User) are agreeing to abide by the following Terms of Use (Terms), any updates to the Terms, and any other guidelines or rules posted from time to time on our web site or in connection with PACT. PACT, a division of The Texas A&M University System’s Performance-based Academic Coaching Teams System or its partnering organizations, reserves the right to modify these terms at any time. As a result, please check the Terms regularly as there may be modifications from time to time. The following agreement (the Agreement) is a binding contract between the User and PACT, which establishes all rights, obligations and liabilities regarding the use of PACT.

One unique username and password is issued for your use alone, is nontransferable, and may not be shared. You are responsible for all uses of PACT using your username and password, whether the use is by you personally or by someone else. You are responsible for protecting and securing your username and password from unauthorized use and disclosure. Sharing of your username and password directly violates the privacy of mentoring relationships among project participants.

The User must comply with all local rules and laws as established in Texas regarding online conduct and acceptable use of Information. Specifically, the User agrees to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which he or she resides.

Ownership of Information

The User acknowledges and agrees that PACT contains activities, tips, examples, resources, research information, tools, graphics, and other material that are protected by intellectual property rights throughout the world including, but not limited, to copyright, trademark and patent rights. The User agrees that the intellectual property rights mentioned in this agreement are valid and protected in all forms existing now or developed later, and that all rights, title and interest to information, including but not limited to all intellectual property rights, belong solely and exclusively to PACT and/or contributors who share information on the PACT web site.

Use of Information on PACT

PACT includes areas for users to post and exchange information, ideas, reflections, and discussions. PACT does not take responsibility for any information posted or exchanged by users on PACT. The PACT mentoring environment presents multiple perspectives on the same topic. The views and opinions expressed therein do not necessarily reflect those of PACT, Users or those of the Texas A&M University System’s Performance-based Academic Coaching Team System or its partnering organizations. Users agree that all rights have been granted and/or secured to any information posted and exchanged on PACT and that the User will not infringe on any personal or proprietary rights of any other Users of PACT.

Further, the User understands that by posting or exchanging any information on PACT, all Users of PACT have full access and may be able to reproduce, distribute or alter your Information. In providing full access to your information on PACT, you grant PACT and all Users of PACT a non-exclusive, copyright-free license to use, adapt, publish, copy or create derivative works from, perform and display information posted by you and other Users to PACT. You as User agree to ask permission and provide credit to original authors of any information that you may use, reproduce, distribute, or alter on PACT. The User can not manipulate identifiers in order to disguise the origin of any information transmitted through PACT. Information on PACT is copyrighted regardless of whether it is marked with a copyright notice. Therefore, materials on PACT are offered to Users of PACT with the intention of following the Terms of this agreement and the laws of the State of Texas and the United States.

Refrain from posting any personal information about oneself or others. This includes address, phone numbers, social security number, students’ names, colleagues’ names, and/or schools’ names in messages posted at any point on the PACT site. Users are reminded that although the electronic mentoring system is password protected, confidential information should not be shared in this space. Conversations in the Chat Rooms or by Message Board are accessible to all participants. Matters of personal or sensitive nature should be discussed outside the PACT system via telephone or email. Users should be aware that any online medium can never be deemed completely private. You also agree not to impersonate another person, purposefully disrupt the normal flow of dialogue in a chat room or on a message board, or use PACT for purposes of advertising or spamming. The Texas A&M University System reserves the right to revoke your User privileges in its sole discretion for violations of these rules.

You as User acknowledge that PACT is for educational purposes only. Therefore, you agree to use PACT for such purposes and not to post any inappropriate information on PACT. Users are responsible for what they post to the web site. PACT reserves the right to remove any information which is inappropriate (i.e. unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, or racially, ethnically or otherwise objectionable, or otherwise deemed harmful to the PACT online community) for PACT and the education community.

In the event that you view or are aware of any inappropriate conduct by any User or third party on PACT or become aware of Users not following the Terms, please notify PACT immediately:

The Texas A&M University System is not responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of the content of such sites not under the control of PACT. The inclusion of such a link does not imply endorsement of the site by PACT or any association with its operators.

Use of Information By Non-PACT Users

PACT offers Users an online community to provide and share information with other Users. You as a User cannot reproduce, use, sell, or disseminate information from PACT to anyone other than registered Users of PACT, including but not limited to others in the same school, district, college or other organization, whether or not for a charge or other consideration, for any purpose, whether commercial or otherwise, without prior written permission of the owner of the information or PACT. PACT cannot guarantee that the reproduction and dissemination of information provided by other Users will not constitute an act of copyright infringement. If you engage in copyright infringement of information on PACT, you will be doing so entirely at your own risk.


The User agrees to indemnify and hold The Texas A&M University System and its regents, members, officers, agents, contractors, co-branders or partners, representatives, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of information sent or transmitted through PACT, the use of PACT, the connection to PACT, the violation of the Terms, or the violation of any rights of another User.

Privacy Policy

The User agrees to comply with the Privacy Policy of PACT. By registering with PACT, you agree that you understand the terms and conditions of the Privacy Policy, and accept them in their entirety. The User acknowledges that PACT may monitor your use of PACT as stated in the Privacy Policy, and may share non-personal information, including but not limited to demographic information, feedback given during the use of PACT, and Message Board posts, for research purposes with non-commercial third parties for research purposes. PACT may retain information contributed from you after the termination of your subscription. By using PACT, the User agrees that PACT may collect, use, and distribute demographic data about Users in aggregated form (so that no User is personally identifiable) for research and other purposes in accordance with the Privacy Policy. PACT will not collect personal information from you unless you provide it.

If you do nothing during your visit but browse through the website, read pages, or download information, we will gather and store certain information about your visit automatically.  This information does not identify you personally.  We automatically collect and store the following information about your visit for statistical purposes: the date and time you access our site, the pages you visit, entries searched for, time and dates of message board posts, and date and time the chat system was accessed. PACT collects this information to measure the number of visitors to the different sections of our site and to make our site more useful to the User.

Throughout our website, you may choose to submit personal information to our website through email.  This information may be seen by various people and may be retained either in electronic or paper format.  Also, email is not secure against interception.  For your own protection, you may wish to contact PACT directly if your submission includes sensitive information.

Termination of Access

PACT may end this Agreement upon the expiration or termination of any User agreement and the individual or organization that paid for your access to PACT. You may terminate this Agreement, and your rights as a User to PACT by notifying PACT of your decision to terminate your access to PACT.

Disclaimer of Warranties

There are no warranties regarding information furnished by Users to PACT. Use of PACT is at the risk of the Users. PACT makes no guarantees or warranties that the PACT system will always be available. The PACT system maybe down at times due to unforeseeable situations concerning downtime or network disturbances such as computer viruses and for regularly scheduled system maintenance. PACT does not make any warranty to the accuracy or reliability of information contributed from Users to PACT. No statement, advice, or mentors comments made by any User or PACT employee, partner, affiliate, associate, contractor, or representative shall be deemed to be warranted and guaranteed by PACT.


Notices to Users will be made on PACT. PACT may also provide notices of changes to the Terms or other matters by displaying notices or links to notices. PACT may also send you invitations for participation in education research surveys. These invitations will be restricted and limited. Your email address will never be divulged.

Trademarks and Copyrighted Materials

PACT and the PACT logos and product and service names are trademarks of the Texas A&M University System’s Performance-based Academic Coaching Team System or its partnering organizations. No one may display or use any PACT trademarks in any manner, without Texas A&M University System’s Performance-based Academic Coaching Team System or its partnering organizations prior written permission. You as User may not use, alter, or reproduce any of PACT proprietary software, database, or source code of PACT without prior written permission.


The Terms of this agreement constitute the entire agreement between the User and the use of PACT. The Terms and the relationship between the User and PACT shall be governed by the laws of the State of Texas without regard to its conflict of law provisions. The failure of PACT to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. If any provision of the Terms is found by a court to be invalid, the parties agree that the other provisions of the Terms remain in full force and effect. Regardless of any statute or law to the contrary, user agrees to file any claim or cause of action arising out of or related to use of PACT or the Terms within one (1) year after such claim.
